1. How to Enter: The Sierra Mist "Mist Opportunity" Sweepstakes II ("Sweepstakes") begins at 12:00:01 a.m. "ET" on May 8, 2007 and ends at 11:59:59 p.m. ET on June 4, 2007 ("Sweepstakes Period"). Eastern Time ("ET") shall control for all purposes of the Sweepstakes. Sponsor's computer shall be the official clock for purposes of the Sweepstakes. Entry: To enter, access the Web Site (listed below) for each of the specific NBC station located in the Geographic Area (defined below) in which you reside: WNBC New York - www.wnbc.com; WMAQ Chicago, IL - www.nbc5.com; KXAS Dallas, TX - www.nbc5i.com; KNTV San Francisco, CA - www.nbc11.com; WVIT Hartford, Ct - www.nbc30.com; KARE Minneapolis, MN - www.kare11.com; KNSD San Diego, CA www.nbcsandiego.com ("Web Sites"). Once at the Web Site for your Geographic Area (defined below), Click on the Sweepstakes icon or text link, either of which will take you to the Sweepstakes home page and entry form. Then, follow the online instructions to complete and submit a Sweepstakes entry form ("Entry"). Information required on the entry form consists of a valid first name, last name, complete address (including ZIP code), telephone number (including area code), date of birth and e-mail address (collectively "Entry Information"). Entries must be received by 11:59:59 p.m. ET on June 4, 2007. All required Entry Information must be completed in full. Limit one (1) Entry per person/per email address/per calendar day. Participants may only enter at the Web Site of the NBC station in the Geographic Area (defined below) in which they reside, and they may only enter at one Web Site. Entries in excess of the stated limits from the same person/email address will be disqualified. Any attempted form of entry other than as described herein is void.
2. Eligibility: This Sweepstakes is only open to legal U.S. residents, who are 18 years of age or older as of May 8, 2007, who are physically located and residing within the terrestrial broadcast signal geographic area ("Geographic Areas", each a "Geographic Area") of one of the following NBC stations, (each a "Sponsor"): WNBC/NBC4 New York, NY (Counties of Bronx, Dutchess, Kings, Nassau, New York, Orange, Putnam, Queens, Richmond, Rockland, Suffolk, Sullivan, Ulster, Westchester Counties in New York; Bergen, Essex, Hudson Hunterdon, Middlesex, Monmouth, Morris, Ocean, Passaic, Somerset, Sussex, Union and Warren Counties in New Jersey; Fairfield County in Connecticut; and Pike County in Pennsylvania); WMAQ/NBC5 Chicago, IL (Counties of Cook, De Kalb, Du Page, Grundy, Kane, Kankakee, Kendall, Lake, La Salle, McHenry and Will in Illinois; Jasper, Lake, La Porte, Newton and Porter in Indiana); KXAS/NBC5 Dallas, TX (counties of Dallas, Denton, Tarrant, Collin, Ellis, Hood, Johnson, Parker, Rockwall, Kaufman, Hunt, and Wise in Texas); KNTV/NBC 11 San Francisco, CA (counties of Santa Clara, Alameda, Contra Costa, San Francisco, San Mateo, Sonoma, Marin, Solano, Napa, Mendocino, and Lake County in California). WVIT-HARTFORD, CT (Counties of Hartford, New Haven, Litchfield, Middlesex, Tolland, Windham and New London in Connecticut); KARE-MINNEAPOLIS (Aitkin, Anoka, Beltrami, Big Stone, Carver, Cass, Chippewa, Chisago, Cottonwood, Crow Wing, Dakota, Douglas, Faribault, Goodhue, Grant, Hennepin, Hubbard, Isanti, Jackson, Kanabec, Kandiyohoi, Lac Qui Parle, LeSueur, McLeod, Meeker, Mille Lacs, Morrison, Nicollet, Pine, Pope, Ramsey, Redwood, Renville, Rice, Scott, Sherburne, Sibley, Stearns, Steele, Stevens, Swift, Todd, Traverse, Wabasha, Wadena, Waseca, Washington, Wright, Yellow Medicine, and counties in Wisconsin: Barron, Burnett, Dunn, Pepin, Pierce, Pine, Polk, St. Croix and Washburn, and KNSD-SAN DIEGO, CA NBC 7/39 terrestrial geographic viewing area in the county of San Diego ('Geographic Area"). Entrant may not, and does not (during six months from Entrant's date of entry), intend to be a candidate for any public office; Entrant may not be a professional actor or a member of SAG, AFTRA, AGVA, Equity or any other guild or union associated with the performing arts. Employees of, Sponsors, NBC Universal, PepsiCo, Inc., Pepsi-Cola Company, WNBC, WMAQ, KXAS, KNTV, WVIT, KARE, KNSD, Skycastle Entertainment, Inc., Sullivan Compliance Company ("Sweepstakes Administrator"), their advertising or promotion agencies, those involved in the production, development, implementation or handling of Sweepstakes, any agents acting for, or on behalf of the above entities, their respective parent companies, officers, directors, subsidiaries, affiliates, bottlers, service providers, prize suppliers, any other person or entity associated with Sweepstakes (collectively "Sweepstakes Entities") and/or members of their immediate families (spouses, children, siblings, parents) and/or persons living in the same household as such persons, whether or not related are ineligible to enter Sweepstakes.
3. Drawing and Notification: Potential winners will be randomly selected in a drawing held on or about June 12, 2007 from all eligible Entries received by Sweepstakes Administrator. Potential winners will be notified by phone, email and/or mail within ten (10) days of the drawing date. If a potential winner cannot be reached after a reasonable effort has been exerted, if he/she is found to ineligible, if he/she cannot or does not comply with these Official Rules, or if his/her prize or prize notification is returned as undeliverable, potential winner will be disqualified and an alternate potential winner may be selected from the remaining eligible Entries. If such alternate potential winner is selected, Sponsors may, in their sole discretion, substitute a prize of equal or greater value.
4. Prizes/Odds of Winning: One (1) Grand Prize: A trip for winner and one (1) guest to Los Angeles, CA. During the trip the Grand Prize Winner (only) will receive an opportunity to participate in a non-speaking "Walk On Role" as an extra ("Walk On Role") at the taping of an upcoming episode of NBC show "The Office" ("Upcoming Episode") (actual episode to be chosen by NBC at its sole discretion). Trip consists of round-trip coach class airfare for two (via an airline carrier selected by Sponsor) from a major airport near winner's home to an airport near Los Angeles, California, hotel accommodations for two (2) nights (one standard room/double occupancy) at a hotel selected by Sponsor and ground transportation between Destination airport, hotel and taping location of Walk On Role. Approximate Retail Value ("ARV") of Grand Prize: up to $3,250.00. Six (6) First Prizes: Each First Prize winner will receive a package of NBC or The Office merchandise consisting of the following: Four (4) The Office T-Shirts, Four (4) The Office Mugs and Four (4) The Office Logo Caps . ARV of each First Prize is: $204.00 NBC or The Office Merchandise to be selected by Sponsors. TOTAL ARV of all prizes is $4,474.00 Odds of winning a prize depends on the number of eligible Entries received. ARV for travel prize may vary depending upon points of departure and destination and fare fluctuations any differences will not be awarded. If the Grand Prize trip is taken, Grand Prize winner must travel during the dates of the taping/production of the Upcoming Episode in which the Walk On Role is scheduled or the element of the Grand Prize that involves participating in a Walk On Role will be forfeited and no additional compensation will be awarded. If Grand Prize winner cannot take trip in on dates specified by Sponsor at it sole discretion in conjunction with the scheduled taping, he/she has one (1) year from first date of notification of winning to take trip to Los Angeles along with the remaining elements of Grand Prize, and no additional or other compensation will be awarded. If trip is not taken within one (1) year of notification of winning, it will be forfeited. Nothing set forth herein shall be construed to require Sponsor to hold the selected taping. "Walk On Role" is the usage of the Grand Prize winner's likeness, and is subject to the requirements of the Upcoming Episode's producer and approval, which may be granted or withheld in such producer's sole discretion. "Walk On Role" may not actually appear in the final version of the Upcoming episode. Participating in the "Walk On Role" is subject to and conditioned upon the winner executing a certificate of engagement and/or other services agreement granting the producer of the Upcoming Episode all rights, titles and interests in and to the results and proceeds of the winner's services on the Upcoming Episode throughout the universe, in perpetuity, and other provisions customary for talent services agreement in the entertainment industry. WINNER'S APPEARANCE ON UPCOMING EPISODE IS SUBJECT TO PRODUCER'S REQUIREMENTS AND SOLE DISCRETION, AND, PRIOR TO PARTICIPATION ON UPCOMING EPISODE, WINNER WILL BE REQUIRED TO SIGN PRODUCER'S FULL STANDARD RELEASE AND TO SUMBIT TO PRODUCER'S STANDARD INTERVIEW AND SCREENING PROCESS AND ANY OTHER REQUIRED DOCUMENTATION. Winner's appearance may not actually appear in the final version of the Upcoming Episode; decision is subject to producer's requirements and sole discretion. Sponsor is not responsible or liable for cancellation or preemption of Upcoming Episode airing winner. Grand Prize winner will receive no compensation regardless of whether Grand Prize winner's walk-on role actually appears on Upcoming Episode. In the event that the taping of Upcoming Episode detailed in the prize description does not or cannot take place as scheduled or at all, for reasons including but not limited to scheduling conflicts, cancellations, postponement, an event of force majeure, or for any other reason, then the remaining components, if any, of the Grand Prize shall constitute full satisfaction of Sponsor's prize obligation to the Grand Prize winner, and no other or additional compensation will be awarded. If taping is cancelled or postponed during winner's trip for any reason, taping portion of Prize will be forfeited and no additional substitute prize or compensation will be provided in lieu thereof. If taping is cancelled or postponed prior to booking, winner will have one (1) year from date of notification of winning to take trip without the "Walk On Role" portion of Prize. Actual Destination of Trip depends on the city where "Walk On Role" will take place. Trip subject to air travel and hotel availability, holiday and black-out dates, and all other prize and travel restrictions. Once determined, no change, extension or substitution of Grand Prize trip dates is permitted, except by Sponsor at its sole discretion. If Grand Prize winner, although 18 year of age or older, is not of the age of legal majority in his/her state of residence, the Grand Prize winner must be accompanied on the trip by his/her parent or legal guardian as Grand Prize winner's guest and parent or legal guardian must sign the Grand Prize winner's affidavit/release documents on his/her behalf. Grand Prize winner's travel guest must be the age of majority in his/her state or residence or older, or if the guest is a minor, the winner must be such minor's parent or legal guardian and must sign the guest affidavit/release on behalf of minor. Grand Prize winner and guest must take air travel on same travel itinerary. Grand Prize Trip winner is responsible for all other incidentals/expenses not specifically mentioned as being included, including, but not limited to, unspecified ground transportation, meals, gratuities, and phone calls. If Grand Prize winner elects to travel with no guest, no additional compensations will be awarded. Airfare does not include government taxes, Passenger Facility Charge or September 11th Security Fee. Airline tickets are non-refundable/non-transferable and are not valid for upgrades and/or frequent flyer miles. If the Grand Prize winner's home is within 100 miles of Destination where the taping of "Walk On Role" is schedule to be held, Sponsor in its sole discretion may substitute a cash payment of $300 in lieu of air travel and Grand Prize winner and guest will be responsible for their own travel to the Destination city. Air travel changes not permitted after ticket issue. Limit one (1) prize per person/family/household. Winners are solely responsible for all costs, incidentals, and any other expenses not specifically mentioned as being included. In the event that a prize component is not available for any reason, then remaining elements of prize shall constitute full satisfaction of Sponsor's prize obligation to winner and no additional compensation will be awarded. Prize notifications and Prize will be shipped to street addresses in Geographic Areas only. Any depictions of prizes are for illustrative purposes only. All federal, state, or other taxes are solely the responsibility of the winners. Grand Prize winner will receive an IRS form 1099 from the Sponsor for the total ARV of prize (stated herein) that he/she won in the calendar year that he/she won.
5. Additional Prize Restrictions: If Sponsor, in its sole discretion elects to incorporate the audio and video recording of Grand Prize Winner in a Series, such appearance will not be considered an employment opportunity, and the Grand Prize Winner will not be entitled to compensation or credit for such appearance. The recording sessions will be of a length determined solely by Sponsor and/or the Series' producer. Should Grand Prize Winner fail to appear timely at the recording sessions, as solely determined by Sponsor the recording session may be cancelled and the Grand Prize forfeited or rescheduled as solely determined by Sponsor. No person(s) other than the winner and persons determined necessary by Sponsor may be present at the recording session. If the audio and video recording is broadcast, such broadcast will be at a time, for a length of time, and on a date solely determined by Sponsor. The winner will be required to agree to, complete and execute the Sponsor's and/or Series producer's related appearance and location releases, affidavits, publicity release and prize release (and such other documents as may be required by Sponsor and/or Series' producer) and failure of winner to complete and execute same (and such other documents as may be required by Sponsor and/or Series' producer), in a timely manner as determined by Sponsor and/or Series' producer, may cause disqualification. Notwithstanding anything to the contrary, the content of the appearance of the winner as, and if, finally broadcast, the number of broadcasts and re-broadcasts, if any, will be as solely determined by Universal Television Networks in its sole discretion. Winner will have no right of review, notice, or approval of the content (including but not limited to editing/modification/alteration/change/whether used alone, together or with other works, acts or content/and/or use in distorted, illusory or composite form) or any broadcast. Winner understands and agrees that Sponsor has the right, in its sole discretion, to disqualify the winner, cause the prize to be forfeited, and remove the winner from the recording session, at any time if the winner's behavior at any point is deemed by the Sponsor to be disruptive, or may or does cause damage to person, property or the reputation of Sponsor or Series' producer, or otherwise violates the policies of the Sponsor, or Grand Prize Winner does not follow the directions of Sponsor or Series' producer at all times. These Official Rules and Sweepstakes are not a contract for employment or an application for employment.
6. General Conditions: Sweepstakes is subject to these Official Rules and all applicable federal, state, and local laws (collectively "Rules and Laws"). Grand Prize Potential winner may be required to sign, execute, have notarized, and return an Affidavit of Eligibility, a Liability Release, (where legal) a Publicity Release, and any other documentation that Sponsor may require (collectively "Affidavit/Release") within three (3) days of receipt of Affidavit/Release or such potential winner may be disqualified and an alternate potential winner may be selected at Sponsor's sole discretion. Travel guest (his/her parent/legal guardian, if he/she is a resident of a jurisdiction that deems him/her to be a minor) may be required to sign, execute, have notarized, and return a Liability Release, a Publicity Release, and any other documentation that Sponsor may require within three (3) days after receipt by potential winner. By returning the completed Affidavit/Release, winner attests to the authenticity of his/her winning entry. Any personal information supplied by entrants to Sponsor or its affiliates will be subject to Sponsor's Privacy Policy posted at the Web Site. Thus, except where prohibited by law and Sponsor's Privacy Policy: (1) entry and/or winner's acceptance of prize constitutes permission for the Sweepstakes Entities to use winner's name, address (city and state), photo, likeness, biographical information, statement and voice for advertising/publicity purposes worldwide and in all forms of media (including posting on Web Site), in perpetuity, without further notice to or compensation in connection with said Sweepstakes or the prize awarded and (2) Sponsor has the right to modify, edit, adapt, electronically alter, use, assign and/or dispose of such Entries however it sees fit and for any purpose without any notice or compensation to entrant or any third parties. By submitting entry information, entrant confirms the accuracy and veracity of the statements and information contained therein. If, for any reason, the Sweepstakes is not capable of running as originally planned, Sponsors at their sole discretion, reserves the right to cancel, suspend or modify the Sweepstakes or any portion thereof and conduct the drawing from all salvageable eligible Entries received, if any. Any person attempting to defraud or tamper with Sweepstakes will be prosecuted and is not eligible for prizes. In case of a dispute over the identity of a potential winner that was selected from Entries, Sponsor reserves the right, in its sole discretion, to deem the winner to be the owner of the member profile corresponding to the winning Entry.
7. Disclaimers: Sweepstakes Entities are not responsible or liable for multiple Entries beyond those permitted by these Official Rules. Entries that are entered by other than human means (such as by an automated computer program or any non-human mechanism, entity, or device), or Entries that are illegible, late, tampered with, forged, incomplete, misdirected, lost, misplaced, stolen, destroyed, or otherwise not in compliance with these Official Rules will be disqualified. By entering Sweepstakes, entrants agree and acknowledge to be bound by the Rules and Laws, as well as the decisions of Sweepstakes Administrator, which are final and binding in all respects; and to waive any rights to claim ambiguity with the Rules and Laws, and that Sweepstakes Entities shall have no responsibility or liability (including, but not limited to, liability for any property loss, damage, personal injury or death) in connection with: participation in this Sweepstakes; human error; incorrect or inaccurate transcription of Entry Information; acceptance/possession and/or use/misuse of the prize awarded herein; any technical malfunctions of the telephone network, computer online system, computer dating mechanism, computer equipment, software, internet service provider; interruption or inability to access Sweepstakes, Web Site or online service via the internet due to hardware or software compatibility problems; any damage to any entrant's (or any third person's) computer and/or its contents related to or resulting from any part of this Sweepstakes; any lost/delayed data transmissions, omissions, interruptions, defects and/or any other errors or malfunctions, even if caused by the negligence of one of the Sweepstakes Entities. Entrants further agree to indemnify and hold harmless the Sweepstakes Entities from any and all liability resulting or arising from his/her participation in the Sweepstakes and/or the acceptance and/or use of the prize, and to release all rights to bring any claim, action or proceeding against the Sweepstakes Entities, and hereby acknowledge that said Sweepstakes Entities have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to the prize. Sweepstakes Entities shall have no responsibility or liability for cancellations and/or delays or any change by the air carrier(s), lodging facilities, or other company or any other persons providing any of components of the Grand Prize for the Grand Prize winner and his/her Guest due to reasons beyond Sponsors and/or Sweepstakes Entities control. The failure of Sponsors to comply with any provision of these Official Rules due to an act of God, hurricane, war, fire, riot, earthquake, terrorism, act of public enemies, actions of governmental authorities outside of the control of Sponsors (excepting compliance with applicable codes and regulations) or other force majeure event will not be considered a breach of these Official Rules.
