Gilroy Police Doubt Parolee's Story About Shot Toddler

A 2-year-old boy who was shot, then dropped off at a Gilroy hospital is improving but police don't believe the story about the way he was injured.Police said the child was shot at a home on Kern Avenue near Mantelli Drive on July 17.Michael Guajardo, the boyfriend of the victim's mother, dropped the toddler off at Saint Louise Hospital in Gilroy and told police the boy had been shot during a scuffle with a rival gang member.
After a thorough investigation, it was determined that the physical evidence found at the scene does not support Guajardo’s allegation of a gang fight.Guajardo, who is a known gang member on parole, also made inconsistent statements about the incident, police said.The Santa Clara County District Attorney’s Office has filed one felony count of child endangerment, and one felony count of a felon in possession of a firearm against Guajardo.Guajardo is 28.
