Judge Rules Enough Evidence For Broussard To Stand Trial

Prosecutor Plays Broussard's Taped Confession

A judge ruled Wednesday that there was enough evidence for Devaughndre Broussard to stand trial for the killing of journalist Chauncey Bailey.

On the first day of a preliminary hearing for Broussard Wednesday, an elderly Oakland man testified that he saw a man shoot Bailey three times in downtown Oakland the morning of Aug. 2.

The witness, who asked that his name not be disclosed, said that as he was standing at the entrance of his building at 275 14th St. in Oakland at 7:23 a.m. he saw a young black man of about average height run across 14th Street to Bailey, who was near the corner of 14th and Alice streets.

The witness, speaking through a translator, said it appeared that the suspect intentionally wanted to shoot Bailey, 57.

The suspect shot Bailey twice, turned away for a brief moment, and then turned back and shot Bailey one more time, the witness said.

The witness said the suspect then got into a white Ford van and was driven away from the scene.

However, the witness was unable to identify Broussard as the shooter.

Several other witnesses took the stand, NBC11's Jodi Hernandez said.

An AC transit bus driver also testified that a man wearing a ski mask and carrying a gun ran up to her bus shortly before the shooting, Hernandez said.

Antoinette Carroll said the man was pointing the gun at the door.

She quickly closed the doors and he ran toward the back of the bus as if he was scoping the bus out, Hernandez said.

The Detective who questioned Broussard took the stand last.

Det. Derwin Longmire testified what led up to the interrogation, Hernandez said.

The prosecutor then played Broussard's taped confession.

He also played two taped phone calls from Santa Rita jail in Dublin.

One was to a woman at the bakery.

The other was to an unidentified man.

In the conversation with the man, Broussard was crying. "You aint ever going to see me again," he said. "They got me for murder."

Broussard was heard telling the man he confessed. The man replied, "No you didn't you stupid ass n****! What is wrong with you? Ain't nothing we can do now".

The man also told Broussard, "I told you to leave those f***ing Muslims alone. Why didn't you listen to me? If you would have you wouldn't be where you're at right now."

The purpose of the preliminary hearing is to determine if there is enough evidence to have Broussard ordered to stand trial on charges that he killed Bailey, who was editor of the Oakland Post.

Broussard worked as a handy man at the bakery, which is headquartered in Oakland.
